Scope of these terms

These Website Terms of Use apply when you access, browse or use the OMAH Services website and when you use the website to initiate a business or project enquiry.

The website is operated under the OMAH Services brand by OMAH LLC. Complete provider-identification information is available in the Imprint.

By continuing to use the website, you agree to use it lawfully and consistently with these terms. These terms do not by themselves create a software-development, consulting or support contract.

Nature of the website information

The website provides general information about software development, workflow automation, data systems, technical strategy, cloud infrastructure, APIs and related professional services.

Website descriptions are intended to explain general capabilities. They are not a guarantee that a particular service, technology, timeline, team member or delivery model is available for every enquiry.

Recommendations, estimates and technical observations published on the website are general information. A reliable recommendation for a particular organisation requires an assessment of its actual requirements, systems, data and constraints.

Project enquiries and initial discussions

Submitting a contact form, sending an email or participating in an initial discussion is an enquiry only. It does not oblige either party to begin a project, reserve delivery capacity or enter into a contract.

An enquiry should contain sufficient information to understand the general request. You are responsible for ensuring that the information you provide is accurate and that you have authority to share it.

Do not send passwords, private keys, authentication codes, production credentials, confidential customer records or sensitive personal information through the public enquiry form or ordinary email.

An enquiry becomes a project only after the relevant parties accept written project terms.

Project proposals and client agreements

Every accepted project should be documented through an appropriate written agreement, proposal, statement of work or equivalent project document.

Depending on the engagement, that document may define:

  • Project scope and excluded work.
  • Deliverables and acceptance requirements.
  • Milestones, dependencies and delivery estimates.
  • Fees, invoices, taxes and payment timing.
  • Client responsibilities and required access.
  • Intellectual-property ownership and licence rights.
  • Data protection, confidentiality and security requirements.
  • Support, maintenance and change-request procedures.
  • Suspension, termination and post-termination obligations.

Where these Website Terms conflict with an accepted project-specific agreement, the project-specific agreement takes priority for that project.

Acceptable use of the website

You may use the website for legitimate informational and business-enquiry purposes.

You must not knowingly:

  • Interfere with the security, availability or normal operation of the website.
  • Attempt to access accounts, systems, files or administrative functions without permission.
  • Introduce malicious code, automated abuse, excessive requests or other technically harmful material.

Ownership of software, source code, designs, documentation, datasets and other project deliverables is determined separately in the relevant client agreement.

Confidential and sensitive information

The public website and its enquiry channels are not intended to function as secure repositories for confidential business information or sensitive personal data.

Information should not be treated as contractually confidential merely because it was submitted through the public website. A confidentiality obligation should be documented separately where required before detailed protected information is shared.

Do not include production credentials, passwords, payment data, private health information, government identifiers or customer databases in an initial enquiry.

Third-party websites and services

The website may rely on or link to third-party services, including hosting, analytics, email, scheduling, communication and external information resources.

Third-party services are operated independently and may apply their own terms, privacy notices and availability conditions. OMAH Services does not control the content or continuing availability of external websites.

A link does not automatically mean that OMAH Services endorses every statement, service or activity of the external provider.

Website availability and changes

Reasonable efforts may be made to keep the website accessible, accurate and secure. Continuous or error-free availability is not guaranteed.

The website may be changed, suspended or temporarily unavailable for maintenance, security work, technical failures, provider interruptions or operational updates.

Responsibility and limitation

OMAH Services makes reasonable efforts to maintain useful and accurate website information. However, visitors should not rely on general website content as the sole basis for a significant technical, commercial, financial or legal decision.

Responsibility for project work, deliverables, performance and remedies is determined by the relevant project agreement and applicable law.

Nothing in these terms excludes or limits responsibility where such exclusion or limitation is not permitted by applicable law.

Privacy and personal information

Personal information connected with website visits and project enquiries is handled as described in the Privacy Policy.

The Privacy Policy explains the website's current contact process, hosting, analytics, operating locations, possible recipients and individual data-protection rights.

Consumer contracts and mandatory rights

The website primarily presents professional software and consulting capabilities for organisations and business projects.

Where OMAH Services enters into a contract with a person acting as a consumer, mandatory consumer protections remain unaffected. Required pre-contract information, cancellation or withdrawal information and other consumer-specific terms should be supplied separately where applicable.

Nothing on this website should be interpreted as waiving a statutory right that cannot legally be waived.

Changes to these terms

These Website Terms may be updated when the website, its features, legal requirements or business operations change.

The revision date displayed at the beginning of the page identifies the current published version. Changes apply to future use of the website after publication.

A change to these Website Terms does not automatically amend an existing signed project agreement.

General provisions

Governing-law, jurisdiction and dispute provisions for paid services should be specified in the relevant project agreement, taking account of the parties' locations and any mandatory legal protections.

If one provision of these Website Terms is found to be invalid or unenforceable, the remaining provisions are intended to continue applying to the extent permitted by law.

Failure to enforce a provision on one occasion does not by itself permanently waive the right to enforce it later.
